This week, I am in a murder trial before the Honorable Bertilla Soto, in the Miami-Dade County Circuit Court.
The right to a trial by jury is a fundamental right. This right is enjoyed by all Americans. That means that if you are accused of a crime, you do not have to plead guilty or simply accept punishment.
What this right means is that if the government (the police and the State Attorney's Office) charge you with a crime, you have a right to force the government to prove you guilty beyond a reasonable doubt.
This is because all accused people enjoy the
presumption of innocence. This is the belief that you are innocent until proven guilty.
This week, I am helping one of my clients exercise the right to a trial by jury. A trial is a fascinating but very important part of the work conducted by a
criminal defense attorney.
