Conspiracy
A conspiracy occurs when two or more people agree to commit a crime and have taken actions towards the crimes completion. It is not enough just to talk about committing a crime. Specific action must be taken in furtherance of that crime.
For instance, if the charge is conspiracy to commit trafficking in cocaine, a conspiracy would only occur if steps were taken to actually commit the crime of cocaine trafficking. Just talking about trafficking is not enough.
To be charged with conspiracy you do not need to actually commit a crime. The conduct of the parties involved needs to indicate an intent to commit the crime.
Common crimes for which the charge of conspiracy may apply:
It is a defense to the crime of conspiracy to abandon the conspiracy. If two or more people discuss committing a crime, and one of the parties abandons the conspiracy before the crime is committed, then that may be a defense to the charge.
