Trafficking Defined
People commonly think that in order to be arrested and charged with
drug trafficking you must be engaged in the sale or transportation of drugs.
In Florida, trafficking is based on two factors: 1) weight of the substance; and 2) possession of the substance. That is it.
In fact, Florida law defines trafficking as, "any person who knowingly sells, purchases, manufactures, delivers, or brings into this state, or who is knowingly in actual or constructive possession of X amount of a controlled substance or illegal drug."

Trafficking is serious because each charge comes with a
mandatory minimum sentence depending on the weight. Those mandatory sentences can range from 3 years all the way up to 25 years.
