Trafficking Defined

People commonly think that in order to be arrested and charged with drug trafficking you must be engaged in the sale or transportation of drugs.

In Florida, trafficking is based on two factors: 1) weight of the substance; and 2) possession of the substance.  That is it.

In fact, Florida law defines trafficking as, "any person who knowingly sells, purchases, manufactures, delivers, or brings into this state, or who is knowingly in actual or constructive possession of X amount of a controlled substance or illegal drug."

Each substance has different weights that constitute trafficking.  Click on the links below to find out about trafficking laws as they pertain to various controlled substances.

1) Trafficking in cannabis (marijuana)
4) Trafficking in oxycodone (OxyContin)

Trafficking is serious because each charge comes with a mandatory minimum sentence depending on the weight.  Those mandatory sentences can range from 3 years all the way up to 25 years.

I am a criminal defense attorney who handles trafficking cases in Miami-Dade and Broward.  If you are in need of an attorney due to trafficking charges, call me today.
