Life Felony Dismissed In Miami-Dade County

While past results cannot determine the future outcome of any case, I am pleased to announce that after over two months of hard work, a client’s life felony was dismissed by the Miami-Dade State Attorney’s Office this morning.

The Client had a prior felony record. Several months ago, he was arrested for breaking into his ex-girlfriend’s house and committing a sexual battery. The Client was charged with burglary with an assault or battery and multiple counts of sexual battery.

Considered a crime of domestic violence due to the prior relationship between the Client and the alleged victim, both police and prosecutors vigorously pursued this case. The Client was arrested by arrest warrant and was taken to jail where he was held in custody without a bond.

At the same time, the alleged victim filed for a restraining order against the Client.

First and foremost, I am pleased to announce that I was able to get the restraining order dismissed.

As far as the criminal case is concerned, the Client was held without a bond. I was able to get the Client released on his own recognizance. The state persisted for over 60 days but finally relented and dismissed the charges.

Since this was both a sex crime and crime of domestic violence, the most experienced prosecutors and detectives were assigned to handle this matter. It was not an easy fight but the result was well worth it.
