Aggressive Trial Attorney With a Reputation for Success

A Miami-Dade mother and daughter returned from their loved one’s gravesite to find that their car had been broken into.

The woman, who along with her daughter, had gone to visit the grave of their deceased husband/father, were at a cemetery in South Miami-Dade County when they realized that one of their car windows had been smashed and a purse that had been left on the seat had been taken.

Officials from the cemetery stated that the only surveillance cameras on the property are located at the entrance. Apparently, there is no video from the actual scene of the break-in.

Burglary of a car in Florida is known as burglary of an unoccupied conveyance. This offense is a third-degree felony punishable by a maximum of 5 years in state prison. For most first-time offenders, the possibility of Pretrial Intervention (PTI) or probation exists. However, pleas in cases like these must be approved by the alleged victim(s). If the alleged victim(s) say no, you could be looking at a felony conviction and possible jail or prison time.

Another aspect to any resolution in a burglary of an unoccupied conveyance case is restitution. If there is damage done to the car or property that has been destroyed or stolen, you will be responsible for any of the victim’s out of pocket costs. This money can be made a condition of PTI or probation.
