Felony Domestic Violence Case Dismissed

After a year of litigation, a domestic violence felony case was dismissed this morning in Miami-Dade Circuit Court.

The client was charged with burglary of an occupied dwelling, violation of an injunction, and criminal mischief.

The allegations were as follows:

The client was served with a restraining order (injunction) which led to a hearing. After the hearing, the client was arrested for the misdemeanor charge of stalking.

Just a few days after posting a bond on the stalking charge, the client was arrested for going to the alleged victim's home and damaging the property. He was then arrested and charged with burglary of an unoccupied dwelling, violation of an injunction, and criminal mischief.

Upon being arrested, the client's previous bond was revoked. It took over a week of continuous bond hearings but Attorney Eric Matheny was able to secure a bond for the client.

Litigation in this case took over one year. Depositions, court hearings, and extensive discovery led to the conclusion that the charges against the client could not be proven.

Today, as we prepared to go to trial in this case, the state dismissed all charges.
