As you know, you can expunge any charge - even murder - so long as the charge was dismissed and you have no prior convictions of any kind on your record.

However, you can only seal eligible offenses for which you received a withhold of adjudication.

There are many crimes that have been designated as ineligible offenses. One of those offense categories are fraud-related charges, specifically under Florida Statute s. 817.034.

This statute includes offenses such as organized scheme to defraud. If you plead guilty or no contest to organized scheme to defraud and receive a withhold of adjudication, you still cannot seal this charge.

However, there are many fraud-related charges that can be sealed, provided you are otherwise eligible.

Charges such as fraudulent use of a credit card CAN be sealed.

Many people are under the impression that all fraud offenses are automatically ineligible. FDLE (Florida Department of Law Enforcement) provides a great deal of information on their website regarding charges that cannot be sealed.
