A DUI manslaughter and leaving the scene of an accident with death trial is underway in Palm Beach County. Circuit Court Judge Jeffrey Colbath is hearing the matter that involves a high-profile defendant.

It is alleged that the accused was driving his Bentley at a high rate of speed and under the influence of alcohol. The Bentley then crashed into the alleged victim's car, sending it into a canal. It is alleged that the accused then fled the scene on foot.

The accused's blood-alcohol content was over twice the legal limit when his blood was drawn hours after the crash. The defense says that the accused had consumed alcohol after the accident but was not impaired while behind the wheel.

The trial is presently underway with the state presenting its case. Upon the conclusion of the state's case, the defense will move for a dismissal of the charges. Since the charges will likely not be dismissed by the Judge, the case should continue with the defense likely calling several experts to rebut the testimonies of state witnesses.

It is unknown whether the accused will testify. An accused person may or may not testify at their own trial. If they testify, their testimony will be evaluated the same as any other witness's. If they do not testify, that fact cannot be used against them.
