Miami-Dade State Attorney Intends For Retrial In "No Body" Homicide Case

After the judge declared a mistrial on the charge of first-degree murder in a homicide case where nobody was ever recovered, the Miami-Dade State Attorney has announced that her office intends to re-file murder charges and re-try the accused.

The accused was convicted at that trial of kidnapping and aggravated child abuse. This morning, a Miami-Dade Circuit Court judge sentenced the accused, a 67-year old woman, to 55 years in prison.

When a mistrial is declared, a judge may permit the state to refile the charges. While it seems like prosecutorial overkill considering the accused will likely die in prison anyway, the state still plans to go forward with the murder charge for a second time.
