Using A Firearm While Intoxicated

Permit or no permit, Florida law does not allow any person to use a firearm while intoxicated.

The only exception is lawful self-defense of one's person or property.

Florida Statute section 790.151 makes it a second-degree misdemeanor to use or have "ready for immediate discharge" a firearm while under the influence of drugs or alcohol.

This is one of many misdemeanor offenses involving firearms in Florida.
