For the past two years, FDLE processing times for applications to seal or expunge Florida criminal records have increased. On average, the wait time from start to finish used to be about 4-6 months. For the past two years, the wait time has been about 6-8 months, sometimes longer.
That’s because FDLE was overwhelmed with a flood of applications. Since there were only so many processors to handle each application, wait times increased.
Over the past few months, it seems as if FDLE as managed to get its caseload under control. According to the FDLE website, applications submitted in March are now being processed. That means that from the date your attorney sends your sealing or expungement application to FDLE, it should be processed within 60 days.
I handle sealing or expungement of criminal records in all 67 Florida counties. I applaud the efforts of FDLE in reducing their caseload. This means that you can expect to have your arrest information cleared from public databases much more quickly.
