Indecent Exposure Defense in Miami-Dade County
Former Prosecutor with More Than 50 Trials Behind Your Defense
An indecent exposure accusation requires close analysis of what allegedly occurred, where it happened, who could see it, and how law enforcement collected the evidence. At The Law Offices of Eric M. Matheny, P.A., we handle these cases as part of our sex crimes defense practice and develop a strategy around the specific facts of each criminal matter.
Attorney Eric M. Matheny is a former prosecutor who has tried more than 50 jury and non-jury trials. We draw on that courtroom and prosecutorial experience to evaluate the state’s case, explain your options, and prepare a defense suited to the charge.

What Florida Law Defines As Indecent Exposure
Florida Statute 800.03 prohibits exposing or exhibiting sexual organs in public, on another person’s private premises, or close enough to those premises to be seen from them when the conduct is vulgar or indecent. It also prohibits being naked in public in a vulgar or indecent manner. A mother breastfeeding her baby doesn’t violate this law.
An accusation under this statute depends on more than the presence of nudity. The prosecution must address the alleged conduct, its location or visibility, and whether it was lewd or otherwise prohibited by law. The evidence must support that characterization under the circumstances.
Important issues in an indecent exposure case can include:
- Whether the accused intentionally exposed or exhibited a sexual organ
- Whether the conduct occurred in public or was visible from another person’s private premises
- Whether the alleged behavior was vulgar, indecent, or lewd
- Whether witnesses accurately identified the accused and described what happened
Penalties for Indecent Exposure in Florida
A first violation is a first-degree misdemeanor. Florida law permits a sentence of up to one year in jail, up to one year of probation, and a fine of up to $1,000. Even a misdemeanor sex crime can significantly affect a person’s criminal record and future opportunities.
A second or subsequent violation is a third-degree felony. Florida Statute 800.035 also makes it a third-degree felony to expose sexual organs while observing a child. The allegations and charging statute determine the level of the offense and the potential penalties.
Registration & Residency Consequences
Sex offender registration isn’t an automatic consequence based on the general name of the charge. Whether registration applies depends on the specific statute, allegations, and final case disposition. When registration requirements apply to a sex crime conviction, related residency restrictions can also have serious practical effects in Miami-Dade County.
We examine the filed charge and possible dispositions before advising a client about these consequences. A first allegation under section 800.03, a repeat violation, and a felony allegation under section 800.035 present different legal issues.
Evidence & Defenses in Indecent Exposure Cases
Our analysis begins with the evidence rather than assumptions based on the accusation. We scrutinize how law enforcement conducted the investigation, gathered evidence, interviewed witnesses, and identified the accused. Attorney Matheny’s former prosecutorial experience informs how we assess the state’s theory and prepare for its arguments.
Intent & Lewdness
Lack of intent can be central when the evidence doesn’t establish intentional vulgar or indecent conduct. Accidental exposure or non-lewd nudity doesn’t necessarily prove every element of the offense. The setting, the actions attributed to the accused, and the surrounding circumstances all require careful review.
Witness Accounts & Identification
False allegations and mistaken identification can lead to charges unsupported by reliable evidence. We compare witness accounts with reports and other available evidence, looking for inconsistencies about the person involved, the viewing conditions, and the alleged conduct.
Visibility & Sufficiency of Evidence
The prosecution must present evidence of the required public setting or visibility from private premises. Disputes over where the incident occurred, whether anyone could see it, and whether the conduct was legally indecent can affect the state’s ability to prove the charge. We build the defense around the evidentiary and legal issues in the case.
What Happens After an Arrest in Miami-Dade County
Most people arrested on a sex crime charge have a bond hearing at the Richard E. Gerstein Justice Building. At this proceeding, a judge considers release conditions while the case is pending. Miami-Dade prosecutors can quickly assign these matters to units focused on sex offense charges, making early defense preparation important.
First-time indecent exposure charges are generally handled as misdemeanors in Miami-Dade County Criminal court. Second or subsequent violations and felony allegations under Florida Statute 800.035 are generally handled in Circuit Criminal court. The charge filed determines the court assignment.
After the initial appearance, the case can proceed through arraignment, additional court appearances, evidence review, and defense preparation. At arraignment, the accused is formally advised of the charge and enters a plea. Depending on the facts and legal issues, the case may conclude through negotiation, dismissal, a plea, or trial.
Our knowledge of Miami-Dade court procedures allows us to prepare clients for each stage. We explain the available information, discuss strategic choices, and keep the defense focused on the evidence in the case.
